Land use entitlement
Land use entitlement means an entitlement to occupy land within NSW conferred through an ownership of shares in a company or an ownership of units in a unit trust scheme, or a combination of a shareholding or ownership of units together with a lease or licence
A sale or transfer of a land use entitlement is liable to duty at the general transfer rate. That is, the same as a transfer of land. Such transfers can also qualify for the First Home Plus scheme if the purchaser qualifies.
Duty is also charged at the general rate if you acquire a land use entitlement by an allotment of shares or issues of units.
Print and complete the relevant OSR form OSD049 for an acquisition of land use by entitlement by an allotment of shares or issue of units.
