Penalties for false claims

It is an offence under the NSW Petroleum Products Subsidy Act 1997 for a person to make a false claim to obtain a subsidy payment to which they are not entitled.

Any person who sells or delivers subsidised petroleum products in a way contrary to the Act or consumes subsidised fuel in a manner contrary to the Act or obtains a subsidy in a manner contrary to the Act commits a default. The Chief Commissioner may issue a notice to any one or all of the above people who have committed a default to recover the amount of subsidy involved and add penalties and interest consistent with the Taxation Administration Act as long as the Chief Commissioner is satisfied that the person involved has acted dishonestly.
