Transmission applications

A transmission application is an application made under Section 93(1) of the Real Property Act 1900 by a person wishing to become the registered proprietor of land as a result of the death of the current registered proprietor.

The applicant may apply either in his/her capacity as:

  • the legal personal representative (executor or administrator) of the deceased owner, or

  • the person entitled to the land under the will or on the intestacy of the deceased owner.

Note: where application is made based on entitlement, the executor/administrator must give written consent to the application.

Once consent has been given the Transmission Application takes the effect of a transfer of the land from the executor/administrator to the applicant.
